User Agreement

Agreement Overview

This User Agreement ("Agreement") is a legally binding contract between you ("User," "Client," or "You") and THOFFICIAL ("Agency," "We," "Us," or "Our"). By using our website, engaging our services, or interacting with our content, you agree to be bound by this Agreement.

If you do not agree with any part of this Agreement, you must discontinue use of our services immediately.

Eligibility

To use our services, you must meet the following criteria:

• Be at least 18 years of age or have parental/guardian consent
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete information when engaging our services
• Not be located in a country subject to trade sanctions or embargoes

User Responsibilities

As a user of THOFFICIAL services, you agree to the following responsibilities:

• Accurate Information: Provide truthful, complete, and up-to-date information in all communications
• Content Rights: Ensure you have the necessary rights, licenses, and permissions for any content you provide
• Timely Feedback: Respond to queries, provide feedback, and approve deliverables within reasonable timeframes
• Payment Obligations: Make all payments according to the agreed schedule
• Confidentiality: Maintain the confidentiality of any proprietary information shared with you
• Data Backup: Maintain backups of your data and content

Use of Services

You agree to use our services in a lawful and ethical manner. Specifically, you agree not to:

• Use our services for any illegal, fraudulent, or unauthorized purpose
• Attempt to gain unauthorized access to our systems, networks, or data
• Interfere with or disrupt the operation of our services or infrastructure
• Reverse engineer, decompile, or disassemble any software we provide
• Distribute or resell our services or deliverables without explicit permission
• Use our services to distribute malware, spam, or harmful content

Payment & Billing

Our payment terms are as follows:

• Deposit: 50% of the total project fee is required before work begins
• Final Payment: The remaining 50% is due upon project completion and deliverable acceptance
• Payment Methods: We accept bank transfers, Easypaisa, JazzCash, and major credit cards
• Late Payments: A 5% late fee may be applied to payments overdue by more than 7 days
• Currency: All payments are in Pakistani Rupees (PKR) unless otherwise agreed

Intellectual Property Rights

Ownership of intellectual property is governed by the following:

• Project Deliverables: All rights transfer to the client upon full payment
• Pre-Existing IP: We retain ownership of any pre-existing tools, libraries, or frameworks used in development
• Portfolio Use: We reserve the right to showcase completed work in our portfolio and marketing materials
• Third-Party Assets: Any third-party assets used retain their original licenses
• Confidential Information: Both parties agree to protect and not disclose confidential information

Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This includes:

• Business plans, strategies, and financial information
• Project specifications, requirements, and deliverables
• Technical details, source code, and system architecture
• Personal data and client information
• Any information marked as confidential

Confidentiality obligations survive the termination of this Agreement.

Limitation of Liability

To the fullest extent permitted by law, THOFFICIAL and its directors, employees, partners, and affiliates:

• Shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Shall not be liable for any loss of profits, revenue, data, or business opportunities
• Shall not be liable for any damages arising from the use or inability to use our services
• Shall not be liable for any damages caused by third-party services or dependencies
• Total liability shall not exceed the total amount paid by you for the specific service or project

User Conduct

You agree to conduct yourself in a professional and respectful manner when interacting with our team. Specifically:

• Be respectful and courteous in all communications
• Provide honest and constructive feedback
• Not engage in harassment, discrimination, or abuse
• Not make false claims or misrepresentations
• Not attempt to exploit or manipulate our team or services

Termination

Either party may terminate this Agreement under the following conditions:

• By User: Written notice with 7 days' notice. You are responsible for payment for work completed to date.
• By Agency: Written notice if you fail to make payments, breach terms, or do not provide necessary information.
• Immediate Termination: We may terminate immediately if you engage in illegal activity, fraud, or harassment.
• Mutual Agreement: Both parties may agree to terminate the engagement at any time.

Governing Law & Disputes

This Agreement is governed by the laws of Pakistan. Any disputes arising from this Agreement shall be handled as follows:

• Informal Resolution: We encourage you to contact us first to resolve any concerns
• Mediation: If resolution is not possible, we may agree to engage a neutral mediator
• Jurisdiction: Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Abbottabad, Pakistan

Changes to This Agreement

We reserve the right to update or modify this User Agreement at any time. Changes will be effective immediately upon posting on this page. We will notify you of significant changes via email or website notification.

Your continued use of our services after any changes constitutes acceptance of the updated terms. We encourage you to review this Agreement periodically.
